Clive Burns Health Coaching ("we", "us", "our") is a sole trader business operated by Clive Burns, based in Tewantin, Queensland, Australia, trading via the website cliveburns.com.
We provide:
- Self-guided online courses and digital content, delivered via Kajabi
- 1:1 in-person coaching sessions
- 1:1 online coaching sessions
- Group online coaching sessions
This policy explains how we collect, hold, use, and disclose personal information β including health information β across all of these services, and how you can access, correct, or make a complaint about that information.

2. What personal information we collect
Depending on how you interact with us, we may collect:
Contact and account information
- Name, email address, phone number, mailing address
- Login and account details for course access (via Kajabi)
- Payment and billing information (processed by Kajabi and/or its payment processor β we do not directly store full card details)
Health and lifestyle information (sensitive information)
- Information you provide in intake forms, questionnaires, or during coaching conversations, such as: general health background, lifestyle habits, sleep, stress, activity levels, dietary habits, and coaching goals
- Notes from 1:1 or group coaching sessions
- Signed waiver/intake form details for in-person sessions (e.g. emergency contact, relevant physical considerations you disclose voluntarily)
We only collect health information that is reasonably necessary to provide coaching, and only with your consent (given by submitting an intake form, waiver, or by voluntarily disclosing it in a session).
Technical and website information
- IP address, browser/device type, pages visited, referral source
- Cookies and similar tracking technologies (see Section 7)
- Course engagement and progress data within Kajabi
Communications
- Emails, messages, or enquiry form submissions
- Feedback, testimonials, or reviews you choose to provide
We do not knowingly collect information from anyone under 18. Our services are intended for adults.
3. How we collect personal information
- Directly from you: course sign-up, checkout, intake/waiver forms, email, coaching conversations (in person, video call, or messaging)
- Automatically: via cookies and website/course analytics when you browse cliveburns.com or use the Kajabi platform
- From third parties: payment confirmation from our payment processor; occasionally from a referring practitioner if you've asked them to share relevant information with us
Where practical, we collect information directly from you rather than from third parties.
4. Why we collect, hold, use, and disclose your information
We use personal information to:
- Deliver the course, coaching, or session you've purchased or booked
- Personalise coaching conversations and track your progress against your own goals
- Process payments and manage your account
- Communicate with you β including course updates, session scheduling, and (with your consent) marketing emails
- Maintain safety and appropriate records for in-person sessions, including waiver information
- Improve our courses, website, and coaching frameworks
- Meet legal and accounting obligations (e.g. record-keeping for tax purposes)
- Respond to enquiries, complaints, or feedback
We do not use your health information to make any automated or algorithmic decision that significantly affects you β all coaching guidance and recommendations involve human judgement. If this changes, this policy will be updated to disclose it, consistent with upcoming automated decision-making transparency requirements.
We will not use or disclose sensitive information (including health information) for a purpose other than the one it was collected for, unless you'd reasonably expect it, you consent, or we're required or authorised by law.
5. Marketing
If you provide your email address (e.g. at checkout, on an intake form, or via a website opt-in), we may send you marketing communications about courses, coaching availability, or related content. You can opt out at any time using the unsubscribe link in any email, or by contacting us directly (Section 10). We won't remove you from essential transactional emails related to a course or session you've purchased (e.g. login details, session reminders).
6. Who we share your information with
We disclose personal information to:
- Kajabi (our course hosting, email, and payment platform) β Kajabi is based in the United States, meaning your information may be stored or processed overseas. Kajabi has its own privacy policy governing its handling of data.
- Payment processors engaged by Kajabi or us, to process transactions
- Email/communication tools, if used separately from Kajabi (e.g. for scheduling or newsletters) β [name specific tools once confirmed, e.g. Calendly, Mailchimp]
- Our accountant/bookkeeper, for tax and financial record purposes
- Insurers, if required in connection with a claim
- Law enforcement, regulators, or courts, where required or authorised by law
We do not sell your personal information to third parties, and we do not disclose health information to anyone outside this list without your consent, except where required by law (e.g. a genuine medical emergency, or a legal obligation to report).
Overseas disclosure
Because Kajabi (and potentially other tools we use) are based overseas, some of your personal information will be held or processed outside Australia, primarily in the United States. Before disclosing personal information overseas, we take reasonable steps to be satisfied that the overseas recipient handles it consistently with the APPs, including relying on the provider's own security and privacy commitments. By using our services, you consent to this overseas storage/processing occurring as described. If you have concerns about overseas disclosure, please contact us.
7. Cookies and website analytics
Our website and course platform use cookies and similar technologies to:
- Keep you logged in to your course account
- Understand how visitors use the site (analytics)
- Support any advertising or retargeting we may run (if applicable)
You can control or disable cookies through your browser settings, though this may affect site functionality (e.g. staying logged in). Where required, we will provide a cookie consent option on the website allowing you to accept or manage non-essential cookies rather than relying on continued browsing as consent.
8. Data security
We take reasonable steps to protect personal information from misuse, interference, loss, unauthorised access, modification, or disclosure, including:
- Using reputable third-party platforms (Kajabi and its payment processor) with their own security safeguards for storing and processing data
- Limiting access to client health/coaching information to Clive Burns and, where relevant, contracted admin support bound by confidentiality
- Storing physical waiver/intake forms (if used) securely, and digitising and securely storing or destroying paper copies where appropriate
No method of storage or transmission is 100% secure. If we become aware of a data breach likely to result in serious harm, we will assess it and, where required under the Notifiable Data Breaches scheme, notify affected individuals and the OAIC within the required timeframe.
9. How long we keep your information
We retain personal information only for as long as reasonably necessary for the purposes it was collected, or as required by law (e.g. tax and business records are generally kept for 5 years). Coaching notes and health information are retained only as long as relevant to your coaching relationship and any reasonable follow-up period, after which they are securely deleted or de-identified, unless a longer period is required by law or insurance purposes.
10. Access, correction, and complaints
You have the right to:
- Ask what personal information we hold about you, and request a copy
- Ask us to correct information that is inaccurate, out of date, or incomplete
- Ask us to delete information we no longer need to hold (we'll let you know if a legal reason prevents this)

Complaints
If you believe we've mishandled your personal information, please contact us first using the details above so we can try to resolve it directly. If you're not satisfied with our response, you can lodge a complaint with the OAIC:
